This action comes into this court on an appeal from a judgment of the Court of Comirion Pleas in favor of the plaintiff-appellee, the action being one in malicious prosecution.

The plain tiff-appédlee had parked his automobile at the south-curb of Central Avenge between East 57th and East 59th Streets. Central Avenue runs iCi an easterly and westerly direction.
