The defendants appeal from the judgment and from an order denying a new trial.
The complaint alleges that the plaintiffs at all times mentioned, were the owners of a tract of land containing one hundred and twenty acres, that they were in possession thereof in March, 1909, and that the defendants on that day ousted them, took possession of the land and have ever since held the same. They pray for the recovery of possession and damages, and for an injunction to prevent defendants from boring wells or extracting oil from the land.
