This litigation is concerned with interesting and somewhat novel legal questions regarding rights of boating, bathing and fishing in an artificial lake.

Frank C. Miller, his brother Rufus W. Miller, and others, who owned lands on Tunkhannoek Creek in Tobyhanna Township, Monroe County, organized a corporation known as the Pocono Spring Water Ice Company, to which, in September, 1895, they made a lease for a term of ninety-nine years of so much of their lands as would be covered by the backing up of the water as a result of the construction of a 14-foot dam which they…
