An action was commenced by the state against the West Publishing Company, a Minnesota corporation, whose business is the publication of law books and legal periodicals and their sale to persons in various parts of the country, for the recovery of taxes levied upon the company under the California Use Tax Act. (Stats. 1935, ch. 361, p. 1297, as amended by Stats. 1937, eh. 401, 671, 683, pp. 1327, 1874, 1935; Stats. 1939, ch. 677, p. 2154; Deering’s Gen. Laws, Act 8495a.)
