1Opinion of the CourtParker, J.
The plaintiff, Palmer, seeks recovery of compensation for services alleged to have been rendered by him for the defendant land company in ef fecting a sale of real property belonging to it. The' company demurred to Palmer’s complaint, challenging his right of recovery upon the facts therein stated, because it thereby appears that his claimed right of recovery is barred by our statute of frauds. The demurrer was sustained by the superior court, and Palmer elected not to plead further. Pinal judgment of dismissal was rendered against him, from which he has appealed to this court.
