Plaintiff Claude R. Fooshe and his wife instituted this action against T. R. Sunshine, John Curci, L. A. Turner, A. W. Foster, and Growers Acceptance Assocation, a copartnership, for rescission of a sale or for damages, in connection with the purchase by plaintiffs from defendants Sunshine, Curci and Turner, of certain farming lands located in the west side of Fresno County. At the time of the sale to plaintiffs, appellant Foster was a farming superintendent for the sellers.
