Defendants have appealed from a judgment on the pleadings in an action brought by plaintiffs for declaratory relief.

The complaint alleged that the parties entered into a joint venture agreement for the construction of a civilian housing project, the profits to be divided equally between the parties; that a month or so later they entered into a second joint venture agreement which provided that certain facilities of the original joint venture should be used in the performance of a job for the Utah Fuel Company, profits to be divided 85 per cent to plaintiffs and 15 per cent to defendants; that…
