Herein the parties will be referred to as they appeared in the trial court. The facts out of which this action arose briefly are as follows:

Upon ‘application of the plaintiff the defendant executed a policy of fire insurance, insuring the plaintiff against loss by fire of certain personal effects, household goods and furniture contained in plaintiff’s home. The amount of the policy was in the sum of $2,-700, covering a period from August 8, 1931, to August 8, 1932.
