OPINION

MAYER, Judge.

This case involves reissue patent claims pertaining to a process for making disposable plastic slippers used extensively and primarily in hospitals. Also at issue is the design patent for the slippers covered by the reissue patent. The slippers have been sold under the trademark “Pillow Paws” since 1962 and have enjoyed considerable commercial success. This suit arose when plaintiffs* accused third-party defendant, American Sealcut Corp., of making convalescent patient slippers under Defense Department contracts using the process and design disclosed by the patents.…
