OPINION OF THE COURT

CARNE, Senior Judge:

This case is before the Court for mandatory review pursuant to Article 66, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 866.

The appellant was charged with attempted murder and rape in violation of Articles 80 and 120, UCMJ, 10 U.S.C. §§ 880 and 920. Initially, he was also charged with a separate offense of murder in violation of Article 118, UCMJ, 10 U.S.C. § 918, however this charge was later severed.1 Despite pleas of not guilty the court-martial with members found the appellant guilty of rape and assault and battery, however, the convening…
