Quinn, Judge:

The question presented on this appeal is the effect of post-conviction medical reports as to the. accused’s mental capacity to commit murder and to cooperate in his defense at the trial.

*499In a sudden and unprovoked attack, the accused battered Sergeant Merrill with a baseball bat. Merrill died the next day from head injuries inflicted in the assault. Charges of murder and wrongful use of marihuana were lodged against the accused, and, in due course, came on for trial before a general court-martial composed of a military judge without court members, as requested…
