MEMORANDUM OPINION AND ORDER
ALBRITTON, Chief Judge.
I. INTRODUCTION
This case is before the court on a Motion for Summary Judgment filed by Electronic Data Systems Corporation (“Defendant” or “EDS”) on December 9, 2003 (Doc. # 14).
