MEMORANDUM OPINION

I. INTRODUCTION

Plaintiff Hestal Lipscomb (“plaintiff’) filed a complaint against defendant Electronic Data Systems Corporation (“defendant”) on July 8, 2005, alleging interference of Lipscomb’s rights under the Family Medical and Leave Act (“FMLA”), 28 U.S.C. §§ 2601 et seq., and unlawful retaliation against Lipscomb for exercising her rights under the FMLA.
