In this action plaintiff, an insurance carrier, who had executed and delivered a standard workmen’s compensation liability policy to employers for valuable consideration, attempted, by filing an independent action in the district court, to obtain a judgment which would relieve it from paying compensation to an employee who previously had been injured and in whose favor an award previously had been made by the commissioner of workmen’s compensation, upon due hearing, against the employer and the plaintiff insurance carrier.
