This was a common law action to recover damages for personal injuries resulting from an accident. A motion by defend*259ant for judgment on the pleadings was sustained and the plaintiff appeals.

Appellee, The Mosby Hotel Company, operates the Jayhawlc Hotel in Topeka, Kan. Appellant, Albert J. Bailey, alleging that he was seriously injured as the result of defendant’s negligent operation of an elevator in the hotel, sought recovery in the amount of $39,163.80.
