Plaintiff, as executor of the last will and testament of Henry Burns Norton, deceased, brought this action to recover damages alleged to have been sustained by the estate of the deceased on account of personal injuries sustained by the deceased in a collision between an interurban electric car, on which he was riding as a passenger, and a certain passenger train of the defendant Great Northern Railway Company, which injuries resulted in Norton’s death.
