This is an appeal from an order granting defendants a new trial after verdict in favor of plaintiff.

In November, 1931, the defendant Joseph A. Mayo, sheriff of Mineral county, levied on a stock of merchandise and fixtures at De Borgia. This was pursuant to a writ of execution obtained by one George R. Cooper’ and directed against plaintiff’s husband, E’. L. Brennan.
