The instant case poses one more problem presented in what has previously been characterized as the “battle of affidavits.”

Tried by general court-martial at Fort Benning, Georgia, accused pleaded not guilty but was convicted of indecent assault on a nineteen-year-old WAC private, violative of Article 134, Uniform Code of Military Justice, 10 USC § 934. He was sentenced to bad-conduct discharge, total forfeitures, and confinement at hard labor for one year.
