This appeal raises an important question regarding the adequacy of the accused’s representation by his appointed defense counsel.

The accused went absent without leave on January 4, 1956. Tie remained absent until apprehended September 15, 1956. Thereafter, he was charged with desertion, in violation of Article 85, Uniform Code of Military Justice, 10 USC § 885.
