1Opinion of the CourtWilliams, J.
This was an action to recover damages for the killing of three mules. The defendants in error do not seem to have been in the habit of permitting the mules to run at large. On the night of the injury they had them shut up in a reasonably safe inelosure, and by some means unknown to the defendants in error they escaped and wandered down a public highway and through a gate opening into the inclosure around plaintiff in error’s right of way, which had been left open.
