Defendant was convicted of the offenses of assault with a deadly weapon and mayhem, upon proof of the commission of a single act, namely, the throwing of a heavy water glass which struck the complaining witness, Davis, in the face, and destroyed the sight of his left eye. Separate judgments were rendered; defendant was sentenced to two terms in state prison to run concurrently and he appeals from the judgments.

The grounds of appeal are that the evidence was insufficient to prove the offense of mayhem for the reason that there was no expert medical testimony that the sight of the eye had been…
