The defendant in error, as plaintiff in the district court, recovered a judgment against the plaintiffs in error, defendants therein, upon an instrument of which the following is a copy:

“$500. Omaha, Neb., March 24,1888.
“Ninety days after date we promise to pay to Dennis J. Keleher, or order, five hundred dollars, for value received, payable at the banking house of McOague Brothers, Omaha, Nebraska, with interest at the rate of ten per cent per annum until paid. Philip Andres, Pres.
