OPINION AND ORDER
LETTOW, Judge.
At trial in this contract case involving spent nuclear fuel, only damages were at issue. The United States Department of Energy (“DOE” or “the government”) has contracted to collect and dispose of spent nuclear fuel (“SNF”) and high-level radioactive waste (“HLW”) that has been and will be created in the course of production of electricity via nuclear means by System Fuels, Inc. and Entergy Arkansas, Inc.
