Plaintiffs Carolina Power & Light Company (“CP & L”) and Florida Power Corporation (“FPC”) claim damages of $91,029,704 from Defendant caused by the failure of the Department of Energy (“DOE”) to collect and dispose of spent nuclear fuel beginning January 31, 1998 under the terms of DOE’s Standard Contract. CP & L and FPC are wholly-owned subsidiaries of Progress Energy, Inc., a public utility in the southeast United States. Plaintiffs’ damages consist of costs incurred in mitigation of DOE’s partial breach of the Standard Contract. This Court has jurisdiction…
