Plaintiff Entergy Nuclear Vermont Yankee, LLC (“ENVY”)2 is claiming damages caused by the failure of the Department of Energy (“DOE”) to collect and dispose of spent nuclear fuel generated at the Vermont Yankee Nuclear Power Station (“VYNPS”), a commercial power plant currently owned by ENVY.
