These two cases were consolidated for trial and appeal. Each is an action for wrongful death. The two decedents were killed when an automobile in which they were occupants was driven off the end of a wharf, owned and maintained by defendant, into the waters of Coos Bay. The facts are the same as those in Hise v. City of North Bend, 138 Or 150, 6 P2d 30. Gohn was the driver of the car; Arney, the only other occupant.
