The plaintiff instituted this action in the county court of Carter county to recover upon a note in the sum of $89.90, with interest thereon and attorney’s fees, and what is usually termed a title note. It was given as part of the purchase price of a binder. 'The plaintiff claimed a lien on the binder, and asked for a foreclosure of 'its lien and the sale of the property. The defendant, W. R.
