The plaintiff seeks a declaratory judgment under the provisions of Chapter 32-23 ROND 1943, which is a legislative adoption of the first thirteen sections of the Uniform Declaratory Judgments Act. ULA, Vol 9, p 215. The defendants demurred to the plaintiff’s complaint on the ground that it does not state facts sufficient to constitute a cause of action.
