In this action the mortgagor seeks to recover damages from the mortgagee for conversion of an automobile.
Plaintiffs in error, J. M. Malone and J. B. Malone, doing business as Malone Investment Company, sold to Jesse Darr, also known as Henry Clark, defendant in error, a secondhand automobile, receiving in return a promissory note for $200 payable in monthly installments, and also, a chattel mortgage on said car.
