This is an appeal by plaintiff from the judgment entered on a verdict in favor of defendant in an action on a combined life and disability insurance policy. The court below refused to enter judgment in favor of plaintiff non obstante veredicto.

According to the agreed statement of facts the defendant company issued to Meyer Rotehsehild, plaintiff appellant, a policy of insurance bearing date July 1, 1921, and described as “Ordinary life plan with disability benefits and double indemnity benefits” in the face amount of $5,000.
