This action was brought by plaintiff, an insolvent banking corporation, to recover from defendant an amount alleged to be due from her as a stockholder of plaintiff, on a call of unpaid capital. The whole of the amount remaining unpaid upon the capital stock of plaintiff was, at the date of the call, September 30, 1895, and ever since has been, necessary to pay depositors and creditors of the corporation.
Plaintiff obtained judgment, and defendant appeals therefrom and from an order denying her motion for a new trial.
