— Plaintiff, by occupation a gardener, while driving a truck along a road on the eastern shore of lake Washington, was so unfortunate as to kill a dog belonging to defendant. Defendant followed plaintiff, and their meeting terminated in a physical conflict between the men, which resulted in defendant’s arrest upon the charge of assault. Of this charge, defendant was found guilty and fined.
