This is an appeal by plaintiff from a judgment in favor of defendant, and from an order denying its motion for a new trial.
The action was one to recover possession of certain mining property and damages for the detention thereof. A jury was impanelled to try the case. After the evidence on the part of the plaintiff was closed, the trial court, on the motion of the defendant, directed the jury to return a verdict for the defendant.
