The complaint in this case alleges that the defendants, George W. Purviance and Peter W. Breene, were copartners under the firm name of George W. Purviance & Co., and that the plaintiff, W. T. Booth, was the assignee and owner of sundry claims against the firm, aggregating $1,712.51. Summons was served upon both defendants. Purviance made default, but Breene answered denying the copartnership, and denying any and all liability against him on account of the claims, or any of them.
