This suit was brought by the defendant in error against the plaintiff in error and George W. Purviance, as copartners, doing business under the firm name of George W. Purviance & Co., upon an indebtedness of the firm-to the plaintiff. The cause was tried and judgment for the amount entered against the defendant Breene alone. From the judgment, as thus entered, Breene appealed to this court.
