The defendant, having been convicted of the crime of murder in the first degree, moved for a new trial, which was denied, whereupon he appealed to this court.
1. After the appeal was perfected, the state asked leave to file a supplemental transcript consisting of corrected minutes of the lower court showing that at all stages of the trial the defendant and his counsel personally were in court, the original minutes of the court, and consequently the original transcript, having failed to show- the fact.
