— The appellee commenced this suit against the appellant on the 25th day of February, A. D. 1878. His complaint consisted of two paragraphs. The first averred, in substance, that the defendant had, by reading to divers persons, maliciously published, of and concerning the plaintiff, a certain letter, in which it was falsely charged that the plaintiff, while in the ax’my had committed the crime against nature, with a mule.
