Plaintiff commenced this action to recover a sum alleged to be due for services rendered by himself and M. E. McCreery as real estate brokers. He prosecutes this appeal from a judgment in favor of defendant.

Defendant, owner of two vacant pieces of real estate in Beverly Hills and in Los Angeles, employed plaintiff’s firm to secure leases on the properties from the Great Atlantic and Pacific Tea Company, hereinafter referred to as the company. On May 18, 1936, defendant signed an agreement in the following words:
