Before the Court are two motions to dismiss (Nos. 79 and 85) filed by Defendant Autoridad de Acueductos y Alcantarillados (“PRASA”). Also before the Court are oppositions thereto filed by Plaintiffs (Nos. 88 and 90). Plaintiffs filed the instant lawsuit pursuant to Puerto Rico tort law to recover for the death of their mother, Irma Cruz-Carrión (“Cruz”), which was allegedly caused by the negligence of Defendants in maintaining the roadways under their possession and control.
