The AVau-rika National Bank, as plaintiff, in the court below, sued the plaintiff in error as defendant, to recover the amount of a negotiable promissory note, dated October 27, 1914, due six months after date, for $300, and interest at 10 per cent, and 10 per cent, attorney’s fées, payable to the order of G. M. Hines, and indorsed in blank by the payee. It was alleged that the bank was the owner and holder of said note in due course, and that the same was past due and no part of the same had been paid.
