Plaintiff brought this action in the circuit court of Wayne county to recover damages for injuries claimed to have resulted from the negligence of the defendant. The declaration in the case, filed May *28127,1957, alleged that plaintiff was a resident of Jackson county, that the defendant corporation was a common carrier, and that on April 20, 1956, it was the owner and proprietor of a certain railroad extending from the city of Pontiac to the city of Jackson.
