In this consolidated decision we act upon two habeas corpus petitions transferred here for decision by the state Supreme Court.

*756In 1976 both petitioners were charged with crime in San Joaquin County, Lee with aggravated assaults and Froberg with robbery. Both were found not guilty by reason of insanity and committed to Atascadero State Hospital, which is located in San Luis Obispo County. On August 1, 1977, both applied for release, alleging restoration to sanity. The San Joaquin County Superior Court ordered petitioners returned to that county, fixed a hearing date and…
