Defendants contracted with one Van Riessen to build a house for them for $11,500. A considerable amount of the material which went into it was furnished by plaintiff. Van Riessen had other contracts and plaintiff furnished material which went into the other jobs. The amount of material furnished by plaintiff for defendants’ house is not seriously disputed. The principal controversy grows out of a check for $1,000 given by Van Riessen to plaintiff.
