The bill of complaint seeks to enforce a mechanic’s lien. Defendants, owners of a lot in the city of Grand Rapids, entered into what is known as a “cost plus” contract with plaintiff for the erection of a garage building on the lot, by the terms of which contract the plaintiff was to superintend the construction of the building, was to provide and pay for materials and labor, and was to receive as compensation for his services 5 per cent, of the total cost of labor and materials, and defendants agreed to pay plaintiff for such labor, materials and services and for that purpose the funds were…
