MEMORANDUM OPINION AND ORDER

RICHARD W. ROBERTS, District Judge.

The plaintiff, Anita Boone, has sued the Secretary of State 1 under Title VII of the Civil Rights Act of 1964 and the Age Discrimination in Employment Act (“ADEA”) alleging that the State Department discriminated against her because of her age, race, and sex by refusing to promote her on two occasions. The Department moves for summary judgment, contending that Boone failed to exhaust her administrative remedies and that she has not rebutted the legitimate, nondiscriminatory reasons offered by the Department for its actions.…
