Plaintiff sued for declaratory relief as to the respective rights of himself and defendant Hyman Gorelnilc concerning the division of profits in connection with business operations of the two on the theory that they were operating as partners or joint adventurers. The trial resulted in a judgment that plaintiff was not entitled to any relief. The controversies between the parties arise out of a written contract under which they began their business associations some time in August, 1935.
