I. Introduction

This action stems from Plaintiff Larry Phillips’s claim against the City of Methuen and a number of individual police officers employed by the City of Methuen regarding alleged violations of Plaintiffs state and federal constitutional rights. Presently at issue are the Supervisory Defendants’ 1 Motion to Dismiss [# 16], the Patrol Defendants’ 2 Motion to Dismiss [# 24] and Defendant City of Methuen’s Motion to Dismiss [# 20].
