This action was commenced in the district court of Murray county by J. D. Ramsey, defendant in error, plaintiff below, against Edna Bryan, executrix of the estate of Charles A. Bryan, deceased, Edna Bryan, Charles Bryan, and Mary Aleott Bryan, minors, Rra E. Pacey, and Mattie P. Pacey, defendants below, only Edna Bryan being plaintiff in error here in this appeal, to recover the sum of $10,000 on a promissory note and for foreclosure of a real estate mortgage given on cex-tain properties, as security for the pay ment of said note.
