This is an original action, a county seat contest, brought in this court under and by virtue of the .terms of an act of the Legislature. Section 16, art. 4, c. 31, p. 385, Sess. Laws 1907-08. The election was held December 8, 1908, and the issues and the pleadings filed in the case were settled in an opinion by this court dated September 14, 1909. Town of Grove v.
