We have for consideration here an appeal from' the Court of Tax Review of the state of Oklahoma. In this opinion the Chicago, Rock Island & Pacific Railway Company will be referred to as protestant, and the county excise board of Pittsburg county will be referred to as pro-testee. The county excise board of Pitts-burg county made and certified to the State Auditor, among others, tax levies for the fiscal year 1928-29 as follows: City of Hartshome, .50 mill for cemetery purposes; city of McAlester, .50 mill for cemetery purposes, 1 mill for library purposes.
